Remote Document Examination in the I-9 Employment Eligibility Verification Process

For almost 35 years, the I-9 Employment Eligibility Verification was designed to be completed in person only. In 2020, in response to the COVID-19 pandemic lockdowns and increase in telecommuting, the federal government issued a temporary rule allowing some employers to conduct I-9 verifications virtually. In August 2023, a modified version of that rule became permanent and available to any qualifying employer. This presentation will discuss employers’ legal obligations after the COVID-19 temporary rule ended in 2023, as well as the eligibility criteria to use the virtual verification process under the permanent rule.
Employee or Independent Contractor Classification Under the Fair Labor Standards Act

On January 9, 2024, the Department of Labor (DOL) announced a six-factor test for determining whether a worker is an employee or an independent contractor under the Fair Labor Standards Act (FLSA). This new rule took effect on March 11, 2024. This presentation will analyze why the distinction between an “employee” and an “independent contractor” matters and the practical impacts of the new six-factor test on different kinds of employees.
